Preferential access to the Mainland: worth checking before you assume it applies

Hong Kong’s trade arrangement with the Mainland can offer real advantages — provided the origin, classification and documentation genuinely line up.

The Closer Economic Partnership Arrangement between Hong Kong and the Mainland provides preferential treatment for qualifying goods and services. For companies structuring supply into the Mainland market, it can meaningfully change the arithmetic — but the benefit depends entirely on meeting the rules of origin, and those rules are specific rather than general.

Origin is where most assumptions break down. Goods that merely transit Hong Kong do not acquire Hong Kong origin, and the substantial transformation tests are precise about what processing qualifies. Getting this right means examining the actual production process, securing the correct certification, and being able to evidence it if the declaration is examined — not simply pointing at a Hong Kong address on an invoice.

Our advice is consistent: treat preferential access as something to be verified per product line, not assumed across a business. Where it applies it is genuinely valuable and worth structuring around deliberately. Where it does not, the far worse outcome is building a pricing model on a benefit that gets disallowed on audit, with duties and penalties applied retrospectively.
